<p>The student, Daniel Glowacki, a junior at Howell High at the time of the incident, was <strong>specifically asked</strong> by McDowell about his feelings on homosexuals. Daniel responded that as a Catholic he was offended by the gay and lesbian lifestyle. Because of his answer, Daniel was ordered to leave the classroom under threat of suspension.</p>
<p>As news of the incident spread, homosexual activists across the country hailed McDowell as a hero and vilified Daniel and his family, as “bigots”, referring to Daniel’s religious objections to the homosexual agenda as “hate” speech. McDowell is head of the school’s teachers union. The Michigan Education Association, the state teachers’ union, supported McDowell’s actions.</p>
<p>National lesbian TV host, Ellen DeGeneres got in on the anti-Glowacki campaign. Daniel even became the subject of a school assembly.</p>
<p>The incident occurred on October 20, 2010, the day that Daniel’s Economics class teacher, Jay McDowell, wore a purple “Tyler’s Army” t-shirt, as part of a national campaign promoted by the Gay and Lesbian Alliance Against Defamation to highlight alleged “bullying” of homosexuals.</p>
<p>Rather than teach academic courses that day, McDowell decided to spend the entire day promoting this national pro-homosexual agenda, which included showing his classes a video concerning such “bullying.”</p>
<p>Richard Thompson, President and Chief Counsel of TMLC, commented: “Rather than teach the required Economics curriculum for which he is paid, McDowell, with the full knowledge of school officials, used his position of authority to promote his homosexual agenda at taxpayer’s expense. This case points out the outrageous way in which homosexual activists have turned our public schools into indoctrination centers, and are seeking to eradicate all religious and moral opposition to their agenda.”</p>
<p>Thompson added, “It defies common sense for schools to ban all sorts of unhealthy foods while at the same time promoting the homosexual lifestyle, which hard statistics show increases drug abuse, suicides and reduces the life expectancies by several years. Schools that promote such lifestyles are engaging in a form of child abuse.”</p>
<p>The incident all started when McDowell ordered a student in his classroom to remove her confederate flag belt buckle because he was offended by it. Daniel pointed out the teacher’s obvious hypocrisy: the teacher can promote a message that might be offensive to students, but students can’t wear clothing that expresses a message that is offensive to the teacher.</p>
<p>In total disregard of his professional responsibilities as a teacher and the constitutional rights of his students, after ordering Daniel to leave the classroom, McDowell asked the remainder of the class whether anyone else did not accept homosexuality. A student raised his hand, and McDowell ordered him out of the classroom as well.</p>
<p>In this case, the teacher became the bully, and the students who opposed his homosexual agenda became his victims.</p>
<p>A 14-year old openly gay student who supported McDowell at subsequent school board meeting appeared on the “The Ellen DeGeneres Show” to discuss his speech. The student was rewarded with a $10,000 academic scholarship by a digital media company.</p>
<p>The Thomas More Law Center (TMLC), a national public interest law firm based in Ann Arbor, Michigan filed the lawsuit on behalf Sandra Glowacki and her son Daniel in the federal District Court for the Eastern District of Michigan. TMLC is representing the family at no charge.</p>
<p>The lawsuit claims that Daniel Glowacki’s constitutional rights to freedom of speech and equal protection have been violated by the policies and actions of the school district and McDowell. Among other things, the lawsuit seeks nominal damages, a declaration that the school policies and actions violate the Constitution, and injunction to prohibit further constitutional violations.  </p>
<p>In cooperation with the NEA, the MEA, and the HEA, and in furtherance of the national agenda of the Gay &#038; Lesbian Alliance Against Defamation (“GLAAD”), the School District permitted the celebration of “Spirit Day” at Howell High School on October 20, 2010. On Spirit Day, people who support the acceptance of homosexuality wear the color purple.</p>
<p>In fact, the School District permitted its teachers to sell purple t-shirts with the slogan “Tyler’s Army” to students and teachers to promote the 2010 Spirit Day. “Tyler’s Army” is a reference to Tyler Clementi who committed suicide after a video of him having sex with another male student in his dorm room was posted on the Internet.</p>
<p>Senior Trial Counsel, Robert Muise, handling the case, stated: “Homosexual activists, with the willing and complicit support of public school districts and teachers’ unions throughout the country, are using our public schools to foist their destructive agenda on our children, thereby creating a hostile learning environment for those students who oppose this agenda on religious and moral grounds.  This case is just one example of the pernicious effect these activists are having on our students and in our community.  We intend to stop it.”</p>
<p>The Howell School District and the Michigan Education Association (“MEA”), which is a subsidiary of the National Education Association (“NEA”), along with the Howell Education Association (“HEA”), which is a chapter of the MEA, have forged a symbiotic relationship and have worked with one another to adopt policies, that promote homosexuality as an acceptable lifestyle and to prohibit religious opposition to homosexuality. The school district has promoted the concept that religious opposition to homosexuality is equivalent to bullying, hate speech, and homophobia in order to eradicate such opposition. </p>

<p>The Bible study group, which met on Sunday mornings, until the City threatened further fines, was perfectly suited for his home, said Chuck Fromm. There was no noise beyond normal conversation and quiet music on the home stereo system. They met inside their family room and patio area. Many neighbors have written letters of support, denying they were disturbed by the presence of the Bible study. The group is not affiliated with any particular church, nor is it seeking to establish a church in the home.</p>
<p>The City of San Juan Capistrano is insisting the home Bible study is not allowed because it is a “church,” and churches require a Conditional Use Permit (CUP) in residential areas. Pacific Justice Institute represents the Bible study participants and will fight the city’s decision. In other cases, PJI has represented larger churches that have been required to spend hundreds of thousands of dollars as part of the CUP process, such as engineering and traffic studies, architectural designs and seismic retrofits. CUP’s require public hearings and can be denied outright or granted with numerous limitations.</p>
<p>“Imposing a heavy-handed permit requirement on a home Bible study is outrageous,” said Brad Dacus, president of Pacific Justice Institute. “In a city so rich with religious history and tradition, this is particularly egregious. An informal gathering in a home cannot be treated with suspicion by the government, or worse than any other gathering of friends, just because it is religious. We cannot allow this to happen in America, and we will fight as long and as hard as it takes to restore this group’s religious freedom.” </p>

The other three, David Wood, Paul Rezkalla, and Negeen Mayel, were arrested along with Qureshi for allegedly “breaching the peace.”  The Christians were led away in handcuffs by police to the applause and cheers of Muslim onlookers who just witnessed a victory of Sharia law over the Christians. </p>
<p>The second incident occurred on June 20, as two missionaries, Rezkalla and Josh Hogg, stood on the public sidewalk handing out the Gospel of John to passersby willing to take them.  The Christians were there for approximately 5 minutes when eight City police officers descended upon them, seized them, and brought them to the police command trailer located inside the festival where the Christians were admonished, photographed, and ordered to stop their peaceful religious activity.</p>
<p>The police assaults and arrests of the Christians, captured on video, caused a national furor over the lawless tactics of the City’s police department.<br />
Dearborn is considered home to the largest Muslim population in America.  As a result, it is evident that City officials, including the Mayor, engaged in this unconstitutional official action solely to please this significant voting bloc and to submit to its will. </p>
<p>The lawsuit was filed on behalf of Acts 17 Apologetics, Dr. Nabeel Qureshi, David Wood, Paul Rezkalla, Negeen Mayel and Josh Hogg.</p>

<p>Even after the acquittals, Dearborn’s mayor, Jack O’Reilly, continued his ongoing and unprecedented personal attacks on the Christian evangelists, accusing them of being anti–Muslim bigots. O’Reilly’s continuous anti-Christian rhetoric was clearly an attempt to curry favor with Dearborn’s large Muslim population, which also explains the Police Department’s alarming mobilization to arrest the four Christians.</p>
<p>Wood and Dr. Qureshi are co-founders of “Act 17 Apologetics,” a ministry group that defends the Gospel of Jesus Christ. On June 18, Mayel and Rezkalla joined them in their missionary work. Dr. Qureshi and Mayel are converts from Islam to Christianity. After the verdict, the group praised the Thomas More Law Center and particularly Robert Muise, whom they described as sharing their emotional burdens and investing more time on the issue than even they did.  The group claimed that without the Thomas More Law Center, they would not have been able to defend themselves from persecution by the City of Dearborn.</p>
<p>Richard Thompson, President and Chief Counsel of the Law Center, commented, “Rob Muise did an outstanding job advocating on behalf of Free Speech rights protected by our Constitution, despite unsubstantiated police claims that peaceful conversations with Muslims were going to incite a disturbance.  The bottom line in the jury’s not guilty verdict: the Constitution, not Shariah law, still prevails in Dearborn, Michigan.”  </p>

<p>The Alliance Defense Fund sent a letter to U.S. Supreme Court officials Thursday that urges them to stop their police officers from prohibiting people from quietly praying outside the court building. “Christians shouldn’t be silenced for exercising their beliefs through quiet prayer on public property,” said ADF Senior Counsel Nate Kellum. “The last place you’d expect this kind of obvious disregard for the First Amendment would be on the grounds of the U.S. Supreme Court itself, but that’s what happened.”</p>
<p>“Mrs. Rigo was not engaging in a parade, procession, or assembly. She was speaking in a conversational level to those around her with her head bowed,” the ADF letter to court officials explains. “There is no reason to silence Mrs. Rigo’s activities since these activities do not attract attention, create a crowd, or give off the appearance of impartiality. The ban on public prayers cannot hope to survive First Amendment scrutiny.”</p>
<p>“The only logical explanation for prohibiting Mrs. Rigo’s activities, while allowing other conversations, pertains to the viewpoint of Mrs. Rigo’s expression,” the letter continues. “Evidently, people may engage in all sorts of conversational expression on Supreme Court grounds unless that expression happens to involve prayer. In doing so, the Supreme Court police have not targeted a subject matter or class of expression, but targeted a particular viewpoint for censorship. They have singled out and censored religious prayer as the only form of conversation to be silenced.”</p>
